TERMS OF SERVICE

Terms of Service & Participation Agreement

Extra Rep Academy Operated by Own The 60 LLC Effective Date: April 2, 2026


1. Agreement to Terms

By registering for any camp, booking a private lesson, joining a travel team program, or otherwise using the services of Extra Rep Academy ("we," "us," "our"), you ("Parent" or "Guardian") agree to these Terms of Service on behalf of yourself and your minor athlete ("Participant"). If you do not agree to these terms do not use our services.

These terms constitute a legally binding agreement between you and Own The 60 LLC, a Florida limited liability company operating as Extra Rep Academy.


2. Parental Consent & Authority

By accepting these terms you represent and warrant that:

You are the parent or legal guardian of the Participant

You have full legal authority to enter into this agreement on behalf of the Participant

You consent to your minor athlete participating in Extra Rep Academy programs and activities

All information you provide is accurate and complete


3. Services

Extra Rep Academy offers the following services:

Private 1-on-1 softball lessons

Summer softball camps

Travel softball programs

Position clinics and specialty sessions

Newsletter and digital content through The Extra Rep

All services are subject to availability and may be modified, cancelled, or rescheduled at our discretion with reasonable notice provided to registered participants.


4. Payment Terms

Lessons: Payment is required in full at time of booking. We accept Venmo, Zelle, credit card, and cash.

Camps: Payment is required in full at time of registration to secure your spot. Early bird pricing is only valid within the specified registration window.

Packages: Lesson packages are paid in full upfront. 5-lesson packages expire 90 days from date of purchase. 10-lesson packages expire 6 months from date of purchase. Expired sessions are forfeited without refund.

Travel Team: Player fees are paid according to the payment schedule provided at time of enrollment. Failure to complete payment may result in removal from the program.

All payments are processed securely through Stripe. We do not store your full payment information on our servers.


5. Refund & Cancellation Policy

Private Lessons: Cancellations made with at least 24 hours notice may be rescheduled at no charge. Cancellations made with less than 24 hours notice forfeit that session. In cases of documented illness or family emergency we will work with you on a credit toward a future session at our discretion.

Summer Camps:

Cancellation 14 or more days before camp start date: Full refund

Cancellation 7–13 days before camp start date: 50% refund

Cancellation within 7 days of camp start date: No refund

Documented injury or medical emergency: Credit toward a future session at our discretion

Travel Team: Player fees are non-refundable once the roster is finalized and uniform orders are placed. If a player withdraws before uniforms are ordered a partial refund may be issued at our discretion.

Extra Rep Academy Cancellations: If we cancel a camp session or program due to circumstances within our control a full refund will be issued. If cancellation is due to circumstances outside our control including but not limited to severe weather, facility unavailability, or acts of God we will make every reasonable effort to reschedule. Refunds in these circumstances are at our discretion.


6. Assumption of Risk

Please read this section carefully. It affects your legal rights.

Softball is a physical sport that involves inherent risks of injury including but not limited to sprains, strains, fractures, concussions, and other physical injuries. By enrolling your athlete in any Extra Rep Academy program you acknowledge and agree that:

You are fully aware of the inherent risks associated with softball training, camps, and competition

You voluntarily assume all risks of injury or illness associated with your athlete's participation in Extra Rep Academy programs

You accept full responsibility for any injury, illness, or damage that may occur during participation

You have ensured your athlete is physically fit and medically cleared to participate in athletic activities

You will notify Extra Rep Academy of any medical conditions, physical limitations, or allergies that may affect your athlete's participation


7. Release of Liability & Indemnification

In consideration of your athlete's participation in Extra Rep Academy programs, and to the fullest extent permitted by Florida law, you hereby release, waive, discharge, and covenant not to sue Own The 60 LLC, Extra Rep Academy, its owner, coaches, volunteers, and staff from any and all claims, demands, losses, damages, or liability arising out of or related to your athlete's participation in any Extra Rep Academy program, whether caused by negligence or otherwise.

You agree to indemnify and hold harmless Own The 60 LLC, Extra Rep Academy, its owner, coaches, volunteers, and staff from any claims, damages, losses, or expenses including reasonable attorney's fees arising out of your athlete's participation or your breach of these terms.


8. Medical Authorization

In the event of a medical emergency during any Extra Rep Academy program, you authorize Extra Rep Academy staff to seek emergency medical treatment for your athlete if you cannot be reached. You accept full financial responsibility for any medical treatment incurred. You agree to provide accurate emergency contact information at time of registration and to keep that information current.


9. Photo & Video Consent

By enrolling in any Extra Rep Academy program you grant Own The 60 LLC a non-exclusive, royalty-free, perpetual license to photograph, film, and record your athlete during camps, lessons, and program activities and to use those images and recordings for marketing, promotional, and educational purposes including but not limited to our website, social media, email marketing, and advertising materials.

If you do not consent to your athlete being photographed or filmed you must notify us in writing at [email protected] prior to your athlete's first session. We will make reasonable efforts to honor your request.


10. Code of Conduct

Extra Rep Academy is committed to a positive, respectful, and safe environment for all athletes, coaches, and families. By enrolling in any program you agree that both you and your athlete will:

Athletes:

Treat coaches, teammates, and opponents with respect at all times

Follow all instructions from coaching staff

Give full effort in every session and practice

Demonstrate sportsmanship in competition and in training

Refrain from bullying, taunting, or disrespectful behavior toward any participant

Parents & Guardians:

Treat coaches, staff, athletes, and other families with respect at all times

Refrain from coaching or instructing athletes during sessions unless invited to do so

Support a positive environment and avoid negative sideline behavior

Follow all facility rules at Nease High School and Palmetto Leaves Regional Park

Direct concerns or feedback to coaching staff privately and respectfully

Violations: Extra Rep Academy reserves the right to remove any athlete or family from a program without refund for serious or repeated violations of this code of conduct. This includes behavior by parents or guardians that disrupts the program or creates a negative environment for other participants.


11. Payment Disputes

If you initiate a chargeback or payment dispute with your bank or card issuer without first contacting Extra Rep Academy to resolve the issue, you authorize us to provide your registration records, communications, and these terms to the payment processor or financial institution as evidence of the legitimate transaction. We reserve the right to pursue recovery of disputed amounts through available legal remedies including small claims court.


12. Health & Safety

You represent that your athlete is in good physical health and has no known medical condition that would prevent safe participation in softball training. You agree to:

Disclose any known medical conditions, allergies, or physical limitations at time of registration

Ensure your athlete is adequately hydrated and appropriately dressed for outdoor activity

Keep your athlete home if they are sick or injured

Not send your athlete to any program while they are experiencing symptoms of illness

Extra Rep Academy is not responsible for illness or injury resulting from undisclosed medical conditions or failure to follow health and safety guidelines.


13. Facility Rules

Programs held at Nease High School are conducted under a facility use agreement between Own The 60 LLC and the school. Extra Rep Academy is a private organization and is not affiliated with or endorsed by Nease High School or St. Johns County School District. All participants must follow facility rules and regulations while on school property.


14. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes arising under these terms shall be resolved in the courts of St. Johns County, Florida.


15. Severability

If any provision of these terms is found to be unenforceable or invalid that provision shall be limited or eliminated to the minimum extent necessary so that the remaining terms remain in full force and effect.


16. Changes to These Terms

We reserve the right to update these terms at any time. Updated terms will be posted at extrarepacademy.com with a revised effective date. Continued use of our services after changes constitutes acceptance of the updated terms.

Extra Rep Academy is not affiliated with, sponsored by, or endorsed by Nease High School or St. Johns County School District. Use of Nease High School facilities is conducted under a separate facility use agreement
